Important Notice: By downloading, installing, or using I'm Alive ("the App"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.

1. Agreement to Terms

1.1 Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and CODESCIENCE NETWORK TECHNOLOGY LIMITED ("we," "us," or "our") regarding your use of the I'm Alive mobile application.

By using the App, you represent that:

  • You have read and understood these Terms
  • You agree to be bound by these Terms
  • You have the authority to enter into this agreement
  • You meet the eligibility requirements described below

1.2 Additional Policies

In addition to these Terms, your use of the App is also governed by:

1.3 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements.

2. Eligibility

2.1 Age Requirements

Minimum Age:

  • You must be at least 13 years old to use the App (16 in the EEA)
  • If you are under 18, you must have parental or guardian consent
  • We do not knowingly collect data from children under the minimum age

2.2 Geographic Restrictions

The App is available worldwide, but certain features may be restricted based on:

  • Local laws and regulations
  • Platform availability (App Store / Google Play)
  • Payment processing restrictions

2.3 Compliance with Laws

You agree to use the App in compliance with:

  • All applicable local, state, national, and international laws
  • All applicable regulations and rules
  • These Terms of Service

3. License to Use the App

3.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the App on your personal device
  • Use the App for your personal, non-commercial purposes
  • Access the features and services we provide

3.2 License Restrictions

You agree NOT to:

  • ❌ Copy, modify, or create derivative works of the App
  • ❌ Reverse engineer, decompile, or disassemble the App
  • ❌ Remove or alter any copyright, trademark, or proprietary notices
  • ❌ Rent, lease, lend, sell, sublicense, or transfer the App
  • ❌ Use the App for any commercial purpose without our written consent
  • ❌ Circumvent or disable any security features
  • ❌ Use automated systems (bots, scripts) to access the App
  • ❌ Interfere with or disrupt the App's servers or networks

3.3 Ownership

The App and all intellectual property rights remain our exclusive property. This license does not grant you any ownership rights.

3.4 Updates and Modifications

We may:

  • Release updates, upgrades, or new versions of the App
  • Modify or discontinue features at any time
  • Require you to update to continue using the App

Updates may be automatic or require manual installation depending on your device settings.

4. User Conduct and Responsibilities

4.1 Acceptable Use

You agree to use the App only for its intended purpose: personal daily check-ins and life tracking.

4.2 Prohibited Conduct

You agree NOT to:

  • Use the App in any way that violates laws or regulations
  • Impersonate any person or entity
  • Upload or transmit malicious code (viruses, malware)
  • Attempt to gain unauthorized access to the App or related systems
  • Interfere with other users' use of the App
  • Use the App to harass, abuse, or harm others
  • Collect or store personal data about other users
  • Use the App for any illegal purpose

4.3 Your Content

You retain ownership of content you create in the App (journal entries, photos).

By using the App, you grant us a limited license to:

  • Store your content on your device and in cloud backups (if enabled)
  • Process your content to provide App features
  • Use anonymous, aggregated data for App improvements

4.4 Content Standards

Your journal entries and photos must NOT contain:

  • Illegal content
  • Content that promotes violence or harm
  • Sexually explicit material involving minors
  • Content that infringes others' intellectual property rights

Note: Your journal is private and not reviewed by us unless required by law or you report an issue.

4.5 Account Security

You are responsible for:

  • Maintaining the security of your device
  • Keeping your device passcode/biometric authentication secure
  • Any activity that occurs through your installation of the App
  • Notifying us immediately of any unauthorized use

5. Purchases and Payment

5.1 One-Time Purchase

I'm Alive - Solo Living is available for a one-time purchase price of $1.99 USD (or equivalent in your local currency).

5.2 Payment Processing

All payments are processed by:

  • iOS: Apple App Store (subject to Apple's Terms)
  • Android: Google Play (subject to Google's Terms)

We do NOT process payments directly or have access to your payment information.

5.3 Pricing

  • Prices are subject to change with notice
  • Price changes do not affect existing purchases
  • Prices may vary by region due to currency conversion and taxes

5.4 Refund Policy

iOS Users:

  • Refunds are handled by Apple according to their refund policy
  • Request refunds through the App Store or reportaproblem.apple.com
  • Refunds are typically available within 14 days of purchase

Android Users:

  • Refunds are handled by Google according to their refund policy
  • Request refunds through Google Play within 48 hours of purchase
  • After 48 hours, contact us at developer@codescie.com

5.5 Taxes

Prices may not include applicable taxes (VAT, sales tax, etc.). Taxes are added at checkout based on your location.

5.6 No Subscriptions

I'm Alive does NOT use subscriptions. Your one-time purchase provides lifetime access to the App and all core features.

5.7 Future Paid Features

We may offer optional paid features in the future (e.g., premium themes). These will be:

  • Clearly marked as optional
  • Not required for core functionality
  • Subject to separate purchase terms

6. Emergency Contact Feature

6.1 Feature Description

The App includes an optional emergency contact feature that:

  • Monitors your daily check-ins
  • Sends notifications to designated contacts if you miss 3 consecutive days
  • Provides your name and last check-in date to contacts

6.2 Important Limitations

This is NOT an Emergency Service:
  • ❌ The App is NOT a substitute for emergency services (911, 112, etc.)
  • ❌ The App does NOT provide real-time monitoring
  • ❌ The App does NOT guarantee notifications will be delivered
  • ❌ The App does NOT verify that contacts receive or act on notifications
  • ❌ The App is NOT intended for medical or safety-critical purposes

6.3 User Responsibilities

You are responsible for:

  • Ensuring your emergency contacts are accurate and up-to-date
  • Obtaining consent from contacts before adding them
  • Informing contacts about how the feature works
  • Using appropriate emergency services for urgent situations

6.4 Disclaimer of Liability

We are not liable for:

  • Failure of notifications to be delivered
  • Contacts not receiving or responding to notifications
  • Any harm resulting from reliance on this feature
  • Network or device failures preventing notifications

6.5 Consent and Privacy

By using this feature, you confirm that:

  • You have obtained consent from your emergency contacts
  • You authorize us to share your name and check-in status with them
  • You understand the limitations described above

7. Intellectual Property Rights

7.1 Our Intellectual Property

The App and all related materials are protected by copyright, trademark, and other intellectual property laws.

We own or have licensed rights to:

  • The App's source code and software
  • App design, graphics, and user interface
  • The "I'm Alive" name and logo
  • All documentation and marketing materials
  • All trademarks, service marks, and trade names

7.2 Your Intellectual Property

You retain all rights to content you create:

  • Your journal entries (text)
  • Photos you attach to entries
  • Any other user-generated content

7.3 License to Your Content

By using the App, you grant us a limited, non-exclusive license to:

  • Store and process your content to provide App features
  • Create backups of your content (if cloud backup enabled)
  • Use anonymous, aggregated data for analytics and improvements

This license terminates when you delete your content or uninstall the App.

7.4 Copyright Infringement

If you believe content in the App infringes your copyright, contact us at:

  • Your physical or electronic signature

8. Disclaimers and Warranties

8.1 "AS IS" and "AS AVAILABLE" Basis

IMPORTANT: The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.

8.2 No Warranties

To the maximum extent permitted by law, we disclaim all warranties, including but not limited to:

  • Implied warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy, reliability, or completeness
  • Uninterrupted or error-free operation
  • Security or freedom from viruses

8.3 Not a Medical or Safety Device

The App is for personal motivation and tracking purposes only:

  • ❌ NOT intended for medical diagnosis or treatment
  • ❌ NOT a substitute for professional medical advice
  • ❌ NOT a safety-critical or life-saving device
  • ❌ NOT intended to detect or prevent emergencies

8.4 No Guarantee of Availability

We do not guarantee:

  • Continuous availability of the App
  • Compatibility with all devices
  • Error-free operation
  • Backup or recovery of your data

8.5 Third-Party Services

The App may depend on third-party services (iCloud, Google Drive, push notifications). We are not responsible for:

  • Availability or performance of third-party services
  • Changes to third-party terms or pricing
  • Data loss due to third-party issues

9. Limitation of Liability

9.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We shall NOT be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of data or content
  • Loss of profits or revenue
  • Loss of business opportunities
  • Personal injury or emotional distress
  • Costs of substitute services

This applies even if we were advised of the possibility of such damages.

9.2 Cap on Liability

Our total liability for all claims arising from the App shall not exceed the amount you paid for the App (currently $7.99 USD).

9.3 Basis of the Bargain

The limitations in this section reflect the allocation of risk between you and us. This limitation is a fundamental element of our agreement.

9.4 Jurisdictional Limitations

Some jurisdictions do not allow exclusions or limitations of certain warranties or liabilities. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

9.5 Indemnification

You agree to indemnify, defend, and hold harmless us and our affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use or misuse of the App
  • Your violation of these Terms
  • Your violation of any rights of another person
  • Your content uploaded to the App

10. Termination

10.1 Termination by You

You may terminate this agreement at any time by:

  • Uninstalling the App from your device
  • Deleting your account through Settings → Delete Account
  • Ceasing all use of the App

10.2 Termination by Us

We may suspend or terminate your access to the App:

  • If you violate these Terms
  • If you engage in prohibited conduct
  • If we discontinue the App
  • For any reason with or without notice

10.3 Effect of Termination

Upon termination:

  • Your license to use the App immediately ends
  • You must cease all use and delete the App
  • We may delete your data from our servers (if applicable)
  • Provisions that should survive (liability, indemnification) remain in effect

10.4 No Refunds Upon Termination

Termination does not entitle you to a refund unless:

  • We discontinue the App within 90 days of your purchase (pro-rata refund)
  • You're eligible under Apple or Google's refund policies

10.5 Data Retention After Termination

After termination:

  • Local data on your device remains until you delete the App
  • Cloud backups (iCloud/Google Drive) follow those platforms' retention policies
  • Anonymous analytics data may be retained for legal compliance

11. Dispute Resolution

11.1 Informal Resolution

Before filing a formal claim, please contact us at developer@codescie.com to attempt informal resolution. We'll work with you to resolve issues within 30 days.

11.2 Governing Law

These Terms are governed by the laws of Hong Kong Special Administrative Region, without regard to conflict of law principles.

11.3 Jurisdiction and Venue

Any legal action must be brought in the courts located in Hong Kong Special Administrative Region. You consent to the exclusive jurisdiction of these courts.

11.4 Arbitration (US Users)

For users in the United States, disputes may be resolved through binding arbitration in accordance with the American Arbitration Association (AAA) rules, except:

  • Claims in small claims court
  • Intellectual property disputes
  • Requests for injunctive relief

11.5 Class Action Waiver

You agree to resolve disputes individually. You waive the right to participate in class actions, class arbitrations, or representative actions.

12. Changes to These Terms

12.1 Right to Modify

We reserve the right to modify these Terms at any time. Changes may be made due to:

  • Legal or regulatory requirements
  • New features or services
  • Security improvements
  • User feedback

12.2 Notice of Changes

We will notify you of material changes by:

  • In-app notification
  • Email (if we have your email)
  • Updating the "Last Updated" date
  • Requiring acceptance before continuing to use the App

12.3 Acceptance of Changes

By continuing to use the App after changes take effect, you accept the modified Terms. If you don't agree, you must stop using the App.

12.4 Version History

  • Version 1.0 - January 11, 2026 - Initial release

13. Miscellaneous

13.1 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.

13.2 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

13.3 Assignment

You may not assign or transfer these Terms. We may assign these Terms to any affiliate or successor without notice.

13.4 Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and us regarding the App.

13.5 Force Majeure

We are not liable for failure to perform due to causes beyond our reasonable control, including:

  • Natural disasters
  • War or terrorism
  • Internet or telecommunications failures
  • Government actions
  • Pandemics or epidemics

13.6 Survival

Provisions that by their nature should survive termination shall survive, including:

  • Intellectual property rights
  • Disclaimers and limitations of liability
  • Indemnification obligations
  • Dispute resolution provisions

13.7 Language

These Terms are written in English. Any translations are provided for convenience only. In case of conflict, the English version prevails.
